IMPORT OF HAZARDOUS CHEMICALS

In accordance with the provisions of Rule 18 of the Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989 and its amendments made thereafter, the following procedure will be followed for the import of hazardous chemicals listed in the Rules :

  1. The importer must submit prior intimation of the import of hazardous chemicals to the West Bengal Pollution Control Board before 30 days or as reasonably possible but not later than the date of import. This information shall include :-

    • The name and address of the person receiving the consignment
    • Port of entry in India
    • Mode of transport from the exporting country to India
    • Quantity of chemical(s) being imported
    • Complete product safety data sheet
    •  

  2. If the West Bengal Pollution Control Board is of the opinion that the chemical being imported is likely to cause a major accident, it may direct the importer to take such safety measures as the Board may deem appropriate. In case the Board is of the opinion that the chemical should not be imported on safety or on environmental ground, the Board will issue direction to stop the import.

  3. The Board shall simultaneously inform the Port Authority to take appropriate steps regarding the safe handling and storage of the hazardous chemicals within the Port premises.

 

In case any importer requires such Certificate for some other reason, the Board will issue the same on receipt of an application and on payment of a fee of Rs. 2,000/- per consignment. The procedure to be followed is as stated below:-

Before submission of the application, the importer shall submit in writing, to the Waste Management Cell of the Board, their reason for applying for an Import Clearance Certificate and shall also indicate their willingness to pay a processing fee at the rate of Rs 2000/- per consignment. The fee can be paid at any of the designated branches of United Bank of India through a challan passed by a Board official.

The application for import clearance shall be submitted to the Waste Management Cell of the Board. Each application shall be supported by the following documents:

  1. Copy of the Invoice

  2. Copy of the Bill of Lading

  3. Copy of Material Safety Data Sheet

  4. Copy of the "Consent to Operate" of the end-user

  5. 3rd copy of the bank challan duly signed by a Board official and stamped by the Bank
